Terms of service

Last updated 18 October 2026

These terms apply when you use Prefera or this website. Prefera is provided by Qestra Limited (“Qestra”, “we”). Organisations with a signed agreement with us are covered by that agreement, which takes priority where it differs.

1. About us

Qestra Limited is a company registered in Ireland with number 809527 and its registered office at Apartment 4, 15 Capel Street, Dublin 1, D01 R683, Ireland. You can contact us at hello@qestra.io.

2. Using Prefera

Organisers (people who sign in to set up polls) must be at least 18 and, if they act for an organisation, have its authority to do so. You are responsible for your account and for the polls you run, including:

  • having a lawful basis to use participants' data, and giving them the privacy information the law requires;
  • the priority scores, rules and options you set, and making sure they are fair and lawful;
  • reviewing results before you release them, and handling participants' questions about their result.

Participants (people who rank choices through a link) only need to submit their own honest choices. Your personal link is private: don't share it, as anyone with it can see your page. Polls are invite-only: you can take part in a poll only if its manager invites you.

3. Acceptable use

Don't use Prefera to break the law, to discriminate unlawfully, to collect data people haven't agreed to give, or to interfere with the service or other people's polls.

4. Personal data

When you run a poll you are the controller of participants' data and we are your processor. Our privacy notice explains how we handle data, and organisations can sign our data processing agreement.

5. Plans and payment

The free plan is provided as it is and may have usage limits. Paid plans are set out in a quote or order form, with prices excluding VAT. We may change the free plan, and will give paying customers at least 30 days' notice of any change to their price.

6. The allocation method

Prefera applies a published method to the rules and data you give it, as described on Why it's fair. We test it thoroughly, but the decision to release results is yours, and you should review them before doing so.

7. Availability and changes

We work to keep Prefera available and secure, but can't promise it will never be interrupted. We may improve or change features; we won't remove a feature an organisation relies on during a poll that is open.

8. Liability

Nothing in these terms limits liability that can't be limited by law, including for death or personal injury caused by negligence, or for fraud. Otherwise, for free use our total liability is limited to €100, and for paid use to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss. If you are a consumer, you also keep your statutory rights.

9. Ending

You can stop using Prefera and ask us to close your account at any time. We may suspend accounts that break these terms. When an account closes, we delete its data as described in the privacy notice.

10. Law

These terms are governed by the law of Ireland, and the Irish courts have jurisdiction.
